Welcome to My Bankruptcy and Creditors Rights Page

written on February 25, 2009 by Tim Richards

For those of you who I did not meet at Thursday's Networking Night, my name is Tim Richards.  I am an associate in the Creditor's Rights group at the law firm of Frantz Ward LLP.   Every week or so, I will be posting an article on COSE MindSpring about some aspect of the bankruptcy process and how a creditor can successfully maneuver within this sometimes complicated world.  My hope is that these articles will educate you on the nuts and bolts of bankruptcy law so that you can protect your rights as creditors.

The articles will begin with some very basic concepts and hopefully progress into more complex areas of the field.  This is my general plan to get things started.  At the end of the day, I want these articles to be practical and useful.  So, please post or email me any topics or questions you might have about bankruptcy law or creditor's rights generally, and I will try to address them in an article.  Of course, in these articles I cannot and will not be giving legal advice on specific legal issues you might have.  Nevertheless, I think the general information provided by these articles will benefit your business by reducing your bad debt.

Here are the first three topics I plan to address.  Again, please let me know if there are any topics you would like me to address in future articles:

1st: A customer just filed for bankruptcy.  Will my customer survive the bankruptcy process?

2nd: A customer who recently paid me $10,000 just filed for bankruptcy. Do I get to keep the $10,000?

3rd: I recently shipped some goods to a customer who just filed for bankruptcy.  Can I get my goods back?

All articles are for discussion purposes only and are not intended as legal advice for any particular situation or intended to form an attorney/client relationship.
