2009  - 100% EM Cap Program for Non-Group Rated Employers

Were You Disqualified from Group in 2009?

The EM is designed to identify the amount of risk an employer carries, based on their current WC experience period.  1.00 is considered average - anything above is penalty rated (above-average risk) and anything below is credit rated (below average risk). 

The BWC has implemented a "capping" program for employers with an EM of 1.01 or greater who were eligible to participate in group rating in 2008, but disqualified beginning with the 2009 policy year

Interested employers must apply by submitting the attached  U-18 Agreement for 100-percent EM Cap to the BWC before September 30, 2009.   

Employers in this program will have their EM% limited or "capped" at 100 percent of the published 2008 EM%.  To be eligible, employers must be current on all fees to the BWC, cannot be lapsed and must have an EM of 1.01 or greater for the policy year beginning July 1, 2009.    

Employers must agree to complete 5 out of 10 steps from the BWC 10-Step Business Plan for Safety (steps 1,2 and 6 are required along with 2 other steps selected by the employer).  The remaining steps must be completed during the second year of the program to remain eligible.  Failure to comply will result in the BWC retroactively removing the cap for the policy year in which the requirements were not met.  The BWC offers free classes on the 10-step business plan and your COSE Compensation Services Account Manager can offer some guidance.

The deadline to apply is September 30, 2009.  No exceptions will be made by the BWC for employers that miss the deadline.
